This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.happymares.co.uk to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

1. INFORMATION ABOUT US

2. RISK AND TITLE

2.1 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

3. PRICE AND PAYMENT

 

3.1 The price of any Products will be as quoted on our site from time to time, except in cases of obvious error.

 

3.2 These prices include V.A.T at the prevailing rate

Delivery charges vary according to the type of goods ordered

3.3 We reserve the right to not approve the sale of goods shown on this website.

4. IMPORT DUTY

 

4.1 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

 

4.2 Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

5. WRITTEN COMMUNICATIONS

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

6. ENTIRE AGREEMENT

 

6.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

 

7. LAW AND JURISDICTION

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

7. RETURNS

Any product that is deemed faulty due to manufacturing should be returned directly to the respective manufacturer whose address can be found on their website. This only refers to new items. Once Loved items do not hold this guarantee. If you have a dispute with a Once Loved Item please contact Happy Mares. All care is taken to mention faults in Once Loved items, but obviously if you are not happy with your once loved goods Happy Mares will refund your money, (but only if you contact us within seven days of purchase), or exchange for different goods, however delivery back to Happy Mares will be at your own cost. Any product that may have been purchased that is deemed to be the incorrect size for the individual can be returned to Happy Mares who will either refund the cost of the purchase or exchange for a different size. The purchaser will be responsible for covering the cost of the courier back to the Happy Mares and shall be responsible for courier service back to their address. If you do require your footwear to be sent back to Happy Mares due to incorrect size, please email us initially at info@happymares.co.uk with your purchase details and requirements. If you have purchased a product and then decide that you do not require it you are entitled to return it within 7 days of purchase.

Claims in respect of short or incorrect deliveries, or damage to goods in transit must be notified to the company, in writing, within 3 days of receipt of goods.

8. All orders are subject to availability. If the goods you have ordered are not available from stock, we weill contact you by e mail or phone. You will have the option either to wait until the item is available from stock or cancel your order. 9.We try to ensure that this website is free from virus or defects. However we cannot guarantee that your use of the website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be held liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
